well you wouldn't get a DUI but if you killed someone with any alcohol you could get charged with vehicular homicide in the 1st 2nd or 3rd degree depending on what you did. That is hardly a slap on the wrist. Even without alcohol if you were speeding and that happened the same would happen your question doesn't make much sense.
